Statutory notice scales with length of service

Under Labour Law No. 4857 the notice period is two weeks under six months of service, four weeks from six to eighteen months, six weeks from eighteen months to three years, and eight weeks beyond three years.

These are statutory minimums. A contract may improve on them; it cannot go below them.

Working the notice, or paying in lieu

Either party may work the notice period or pay in lieu of it. Pay in lieu is taxed as ordinary income, unlike severance pay — so the gross figure here is not what leaves the bank account.

If the employee works the notice, no payment in lieu arises.

Frequently asked questions

Does notice pay apply when the employee resigns?
The obligation runs both ways. An employee who resigns without giving statutory notice can in principle owe notice pay to the employer, though in practice employers rarely pursue it.
Is notice pay taxed like severance?
No. Severance is exempt from income tax; pay in lieu of notice is not. It is taxed as ordinary employment income.
